Ministerial regulation amending article 2 of the Regulation on economic traffic measures
COVID-19
Having taken into consideration:
that the number of reported infections has risen significantly from 15 cases in a short period of time
April 28, 2021 to 49 cases on May 18, 2021, with a rapid rise to 74 cases thereafter
on May 20, 2021;
that it is important to avoid a possible third wave;
that a negative change in the international ranking must be made to travel to St. Maarten
will be prevented;
that it is considered desirable in the interests of the business and economy of Sint
Maarten to bring forward the closing times of publicly accessible locations to 11 p.m.
Considering:
Article 2 of the Regulation on economic traffic measures COVID-19
HAS DECIDED:
Article I.
Article 2 pertaining to the COVID-19 Economic Traffic Measures Regulation will read as follows:
Article 2
1. It is forbidden to open premises accessible to the public between 23:00 and 06:00
have, which in any case must be understood to mean
bars;
b. night clubs;
c. discotheques;
d. restauran
e. hotel bars; and,
f. spaces that are rented out for meetings, events and parties.
2. The prohibition referred to in the first paragraph does not apply with regard to:
hotels and lodgings, as far as their own guests and staff are concerned, and;
b. land and buildings of the airport and of the seaports; or
c. Minister’s decision
3. The Minister of Tourism, Economic Affairs, Traffic, and Telecommunications may by decision,
deviate from the provisions of the first paragraph.
Article II
In view of the urgent interest as referred to in Article 127, third paragraph, of this ministerial regulation
the Constitution in force with effect from 23 May 2021. These regulations will be published in the
Notice sheet.

EXPLANATORY STATEMENT
At present, the number of active cases has increased significantly from 15 active cases in a short period of time
on April 28, 2021 to 49 cases on May 18, 2021, with a rapid rise to 74 active cases
on 20 May 2021. Targeted intervention in the event of a rapid increase in the number of active cases is important.
Also in view of the prevention of a possible third wave, it is necessary to apply appropriate
to take measures.
In addition, a negative change with regard to the international ranking must be transferred to Sint Maarten
to travel, to be prevented.
In order to control the number of infections and prevent a further increase, the
importance of the activity and economy of Sint Maarten, it is desirable to accept the closing times
brought forward to 11 pm.
Depending on the COVID-19 developments, the Minister of Tourism, Economic Affairs,
Traffic and Telecommunications may deviate from the closing times in these regulations by decision.
