St. Maarten – The Court in First Instance ruled that the St. Maarten Housing Foundation (SMHDF) has to pay its former financial controller Emilio Kalmera his full salary and vacation allowance over the period April 1 – July 1 – an amount of approximately 45,000 guilders. The foundation also has to pay legal cots to the tune of around 4,500 guilders.
Kalmera started working for the foundation on August 1, 2012 and was suspended on December 12 of last year, pending an investigation into possible irregularities surrounding Director Henry Lynch.
The court rejected Kalmera’s 25,000 guilders claim in damages for wrongful act, ruling that he had not substantiated this claim sufficiently, while the foundation put up an extensive defense against the allegations.
