Armed robbery accomplice given 20 months in prison

PHILIPSBURG–Jermaine Emanuel Carty (29), who was found guilty of involvement in the armed robbery of Abu-G. shawarma restaurant on A.Th. Illidge Road on June 14, was sentenced Wednesday to thirty months, ten of which were suspended. The Prosecutor had called for five years.

  Carty’s co-defendants, his neighbour among them, were sentenced on August 16 to three years, one of which was suspended, on three years’ probation.

  The Court of First Instance found it proven that Carty was the designated driver who took the two robbers to the restaurant and drove off with them after the robbery, during which some US $450 and 100 euros were taken from the cashier at gunpoint.

  Pursued by the restaurant owner, Carty drove his car to the parking lot of Le Petit Chateau brothel, where the robbers fled on foot. Carty turned himself in to the police in the early morning.

  The Prosecutor found it proven that the defendant, who was sentenced to four years in 2013 for severe assault and who was found guilty of being an accessory to murder in 2009, had been involved in armed robbery.

  The Prosecutor held Carty for the “evil genius” behind the robbery, which he had planned because he needed money.

  Attorney Sjamira Roseburg said her client had confessed to taking part in the robbery, but said he had only been of service as the driver of the getaway car. Therefore, she stated it could only be proven that her client was an accomplice to robbery.

  The Judge found theft with violence and the joint possession of two firearms proven, for which he called for a prison sentence of five years. The Judge said Carty had made a “real contribution” to the armed robbery.

  However, the Court did not find it proven that Carty had been the mastermind of the crime. According to the Court, his neighbour had played this role, as stated by the third suspect in this case.

  Therefore, the Judge arrived at the conclusion that there was insufficient evidence to consider Carty a co-perpetrator. However, his car was confiscated.
