ASL refutes MJP accusations over Baie Rouge demolition | THE DAILY HERALD

MARIGOT–Association Syndicale Libre (ASL), the Terres Basses owner’s association, responded to Movement for Justice and Prosperity’s (MJP) press release published in the various print media regarding the demolition of Chez Raymond on Baie Rouge.

Quoting the MJP release: “According to Mr. Mussington the order to demolish is not yet pronounced definitively … the association of Lowlands has granted itself the right to demolish.”

The association of Terres Basses specifies that the summary order (enforceable) of May 29, pronounced by the Tribunal de Grand Instance (TGI) of Basse Terre: “Orders Mr. Augustin Arrondel and Mr. Louis Raymond Mussington to demolish all the buildings within a delay of one month from the date of the order. After this period, if the order is not complied with, Mr. Arrondel and Mr. Mussington shall be ordered to pay a penalty payment of 800 euros per day to the ASL.

“The order was served by the bailiff on June 12, 2018. The occupants (Arrondel and Mussington) therefore had to vacate the premises and destroy the buildings, at their exclusive expense, before July 12, 2018. (Note that an appeal from an enforceable interim order does not suspend its enforcement).

“On August 19, 2018, the Public Prosecutor’s Office enforced the order with the support of the Gendarmerie Nationale and seized the sealed equipment and accessories. On August 20, 2018, in the morning, the demolition of the illegal constructions and the cleaning of the car park were undertaken at the expense of the Lowlands owner’s association. As soon as the cleaning work was completed, access to the car park was reopened to those wishing to go to the beach.”

According to Mr. Mussington in the MJP release: “The public domain is inalienable …”
“Yes, except in the overseas territories and in St. Martin, some beaches have had a private character since the 1950s (Beauperthuy case in Orient Bay), but on June 11, 1959, the French government of the time (De Gaulle) had ceded the beaches (the 50 pas géométriques) of Terres Basses to the developer-founder of the allotment provided, as a reminder, that the beaches were free for access for all, unbuildable and without commercial activity. This is respected in the Lowlands where beaches are accessible to all.”
