Port files complaint in court against Prosecutor’s Office | THE DAILY HERALD

PORT–Port St. Maarten filed a notice of complaint in the Court of First Instance on Friday, February 15, against the Prosecutor’s Office for its refusal to prosecute the American dredging company Devcon.

  The Port’s request for such prosecution concerns the Emerald investigation, in which Devcon turned out to presumably have secretly and illegally raised invoices to a total amount of more than US $3 million. The invoices refer to dredging activities in the Port covering 2012 to 2016. The Port wants to reclaim these amounts of money, as they were paid without any legal basis which the Port found out recently.

  As a victim of a possible crime, the Port has the right to request for prosecution and to formally complain against the refusal of such prosecution, the Port said is a press statement issued this morning.
