GREAT BAY--The Prosecutor’s Office OM SXM, the Police Force of Sint Maarten (KPSM) and the St. Maarten Civil Aviation Authority (SMCAA) have launched the awareness campaign “Respect the Sky – Fly Safe, Stay Safe” to promote safety around Princess Juliana International Airport and preserve the Maho Beach experience.
The campaign focuses on preventing two key dangers at Maho Beach: drone activity in the airport’s approach zone, and throwing or launching objects (phones, GoPros, hats, etc.) toward low-flying aircraft. Both acts are prohibited by law because they can cause serious danger to air traffic and to people on the ground.
Under Ministerial Decree 2019/223 and the Luchtvaartlandsverordening, Maho Beach and the area around Princess Juliana International Airport are officially designated as “No Fly Zones” for drones, unless an exemption permit is issued. Intentionally violating this regulation is punishable by up to two (2) years imprisonment and/or a fine up to XCG 100,000/ USD $55,555.
Under Articles 2:111a and 2:111b of the Penal Code, anyone who intentionally or negligently causes danger to air traffic, including by throwing or launching objects toward an aircraft, can face up to fifteen (15) years imprisonment or a fine up to XCG 100,000/ US $55,555 if done intentionally; or up to one (1) year imprisonment or a fine up to ANG 25,000/ US $13,873 if done by negligence or recklessness.
These penalties may sound severe, but they exist for a simple reason: to protect lives. Even a small object or drone can be sucked into an aircraft engine or hit the cockpit, putting passengers and crew in danger.
Authorities emphasize that this campaign is not meant to discourage visitors, but to ensure everyone can continue enjoying the thrill of Sint Maarten’s famous low-landings safely and responsibly.
