Lighter sentence for facilitating travel with forged papers

GREAT BAY – The Common Court of Justice sentenced Calvin Elroy Simmonds yesterday to a 10-month conditional prison sentence and imposed 3 years of probation for facilitating the attempted entry of two women into St. Maarten with forged documents on April 13, 2016.

The Court in First Instance had sentenced Simmonds on December 14 of last year to 14 months of imprisonment.

The appeals court considers it plausible that Simmonds facilitated the women against a relatively small financial compensation. The court took into consideration that Simmonds recently suffered a cerebral hemorrhage; given this medical condition, the court refrained from imposing community service.

Immigration intercepted on April 13, 2016 two women at the airport who traveled with a French “recepisse de demande de carte de sejour” – a document that proves that its holder had submitted a request for a residence permit.

The officer who examined the documents found that their color, details and the used production and security techniques differed from the official document the French authorities issue for this purpose. The conclusion was therefore that the documents were forgeries.

The two women were earlier sentenced to conditional prison sentences and community service.
