Two men appear in the local court. Managers of a popular beach bar-restaurant in Grand-Case, they are accused of having concealed salaried activity of four employees.

 

It all begins on October 9, 2023, during a anti-fraud control operation carried out on site by the Labor Inspectorate, theURSSAF and the General Directorate of Public Finances.

While several people are busy serving customers, Four employees' statements indicate undeclared work, without a prior contract or official pay slip. In front of the investigators, they claim to be paid 10 dollars an hour and come at a fixed time for four months, all week.

Overwhelmed by the evidence, the managers invoke a fragile defense : “We only employed family members, only occasionally, to help out.” English speakers living on the French side, they cite their lack of knowledge of the French labor law : URSSAF? Unknown to anyone. Social security contributions? Vaguely heard of them. “This is the first time we've had a business, we didn't know we should have declared them.”

In front of the judges, they assure having managed the tourist season at “two, between cousins", an argument that is not very credible when the daily average of covers is around 40When questioned by the prosecutor about their remuneration, they stated that they did not pay themselves a salary and that they fed themselves on site.

Faced with the fragility of their arguments, and after 1.5 hours of file analysis, the verdict falls: the company is found guilty of undeclared work between April and October 2023 and must pay a fine of 50,000 euros, 40,000 of which is suspended, for the damages suffered. The court decision will be published in the local press., at the expense of the condemned establishment, within two months. _LA
